Legal Basis for Instagram Giveaway Offering 3 Nights for Free:

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING.

Eligibility: This giveaway is open to all Instagram users who are at least 21 years old. Employees of Lumina Stays and their immediate family members are not eligible to participate.

Entry: To enter the giveaway, participants must follow the following steps:

  1. Like the giveaway post.
  2. Follow Lumina Stays on Instagram.
  3. Tag at least two friends in the comments section of the giveaway post.

Giveaway Period: The giveaway will begin on 8/15/23 at 6pm EST and end on 9/4/23  at 11:59pm EST. Entries submitted outside of this period will not be eligible.

Winner Selection: The winner will be selected randomly from all eligible entries received during the giveaway period. The winner will be announced on 9/5/23 on Lumina Stays’ Instagram account and will be notified via direct message. If the winner does not respond within 2 after the initial contact, a new winner may be selected.

Prize: The prize for this giveaway is three (3) nights of free accommodation at a Lumina Stays property of the winner’s choice, subject to availability. The prize is non-transferable and cannot be exchanged for cash or any other alternative. Lumina Stays reserves the right to substitute the prize with an item of equal or greater value if necessary.

PRIZE CONDITIONS: Prize is not redeemable for cash, assignable or transferable. Sponsor reserves the right to substitute a prize of equal or greater value at its discretion. Any other incidental expenses on prize not specified herein are the winner’s sole responsibility. The three-night stay is only available at studios, one bedroom or two bedroom units.

All travel related expenses, including but not limited to, air and ground transportation, taxes, gratuities, incidentals, upgrades, insurance, service charges, hotel, resort or property fees, food & beverage and personal expenses are the sole responsibility of prize winner and/or his/her travel companion(s).

Photo identification and credit card or cash deposit may be required at any time for incidental charges (e.g., room service, use of telephone/IT services, laundry and all other optional extra services not provided in the Grand Prize). All rental unit reservations are based on availability, dates between December 1st and January 31st are excluded.

Accommodations are subject to availability at time of reservation. Blackout dates, advance booking requirements and travel restrictions may apply. Availability is subject to factors such as weather, seasonality and space availability. Reservations are subject to availability. If weather or other incident or conditions beyond the control of the Sponsor affects the ability for winner and his/her travel companion to redeem any portion of prize during the scheduled date and time, then the Sponsor shall have no further obligation to the winner and/or travel companion other than to supply the remaining elements of the prize package minus the unused portion of prize. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever. Sponsor is not liable for expenses incurred as a consequence of flight cancellation/delay.

In the event a winner or his/her travel companion engages in behavior that, as determined by the Sponsor in its sole discretion, is obnoxious or threatening, illegal, that is intended to annoy, abuse, threaten or harass any other person, or that in any way disparages or adversely affects the reputation, image, and/or customer goodwill of Sponsor or any of Sponsor’s services, products, trademarks, service marks, or logos, Sponsor reserves the right to terminate the trip early, whole or in part, and send the winner and/or his/her travel companion home with no further obligation or compensation whatsoever to winner and/or travel companion. In the event a winner engages in behavior during travel that (as determined by Sponsor in its sole discretion) is illegal, tortious, or subjects winner to arrest or detention, Sponsor shall have no obligation to pay any damages, fees, fines, judgments or other costs or expenses of any kind whatsoever incurred by winner as a result of such conduct. SPONSOR SHALL HAVE NO LIABILITY FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING FROM OR ARISING OUT OF ANY TRAVEL RELATED TO THE PRIZE OR ANY OTHER ASPECT OF GRAND PRIZE WINNER’S ACCEPTANCE OR USE OF THE PRIZE.

Publicity: By entering this giveaway, participants grant Lumina Stays the right to use their Instagram username, name, and any submitted content for promotional purposes without any additional compensation.

Privacy: Any personal information provided by the participants for this giveaway will be used solely for the purposes of administering the giveaway and will not be shared with third parties without consent.

Release of Instagram: This giveaway is in no way sponsored, endorsed, or administered by Instagram. Participants release Instagram from any and all liability related to this giveaway.

Agreement to Rules: By participating in this giveaway, participants agree to be bound by these rules.
